TothePeopleoftheStateofNewYork:
THEremainingpowerswhichtheplanoftheconventionallotstotheSenate, inadistinctcapacity, arecomprisedintheirparticipationwiththeexecutiveintheappointmenttooffices, , , therefore, concludethisheadwithaviewofthejudicialcharacteroftheSenate.
, or, inotherwords, , , forthisreason, willseldomfailtoagitatethepassionsofthewholecommunity, -existingfactions, andwillenlistalltheiranimosities, partialities, influence, andinterestononesideorontheother; andinsuchcasestherewillalwaysbethegreatestdangerthatthedecisionwillberegulatedmorebythecomparativestrengthofparties, thanbytherealdemonstrationsofinnocenceorguilt.
Thedelicacyandmagnitudeofatrustwhichsodeeplyconcernsthepoliticalreputationandexistenceofeverymanengagedintheadministrationofpublicaffairs, , inagovernmentrestingentirelyonthebasisofperiodicalelections, willasreadilybeperceived, whenitisconsideredthatthemostconspicuouscharactersinitwill, fromthatcircumstance, betoooftentheleadersorthetoolsofthemostcunningorthemostnumerousfaction, andonthisaccount, canhardlybeexpectedtopossesstherequisiteneutralitytowardsthosewhoseconductmaybethesubjectofscrutiny.
Theconvention, itappears, , willbeleasthastyincondemningthatopinion, andwillbemostinclinedtoallowdueweighttotheargumentswhichmaybesupposedtohaveproducedit.
